Terms of Service
Effective date: 09/24/26 · Last updated: 10/04/26
These Terms govern your use of the FlagStick app, operated by FlagStick, Inc. ("FlagStick"). By creating an account, you agree to them.
Eligibility
You must be at least 13 to use FlagStick and capable of forming a binding contract.
Your account
You're responsible for the activity on your account and for keeping your sign-in secure. One account per person; no impersonation.
Your content and license to us
You own the rounds, ratings, reviews, and other content you post ("User Content"). By posting it, you grant FlagStick a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute it within the app and in FlagStick's own marketing (e.g., featuring a course leaderboard) — this license ends when you delete the content or your account, except that content already re-shared or saved by another user before deletion may persist in that form, we may retain copies for a reasonable period in backups or caches, and content that's been aggregated into de-identified rankings or statistics may be retained in that de-identified form.
You're responsible for what you post. Don't post content that's false, defamatory, infringing, or that you don't have the right to share.
Prohibited conduct
- Posting fake rounds, fake ratings, or manipulating the ranking/comparison system
- Harassment, hate speech, threats, or targeting another user
- Impersonating another person, course, or FlagStick itself
- Scraping, reverse-engineering, or accessing the app through unauthorized means
- Using FlagStick for any unlawful purpose
Violations can result in content removal, suspension, or termination — see Community Guidelines below for the specific enforcement process.
Copyright complaints (DMCA)
If you believe content on FlagStick infringes your copyright, send a notice to support@flagsstickgolf.com with: (1) a description of the copyrighted work; (2) the location of the allegedly infringing material in the app; (3) your contact information; (4) a statement that you have a good-faith belief the use isn't authorized; and (5) a statement, made under penalty of perjury, that the notice is accurate and that you're authorized to act on the copyright owner's behalf. We'll remove or disable access to reported content and notify the user who posted it. If you believe your content was removed in error, you can submit a counter-notice to the same address. We may terminate the accounts of repeat infringers.
Course and third-party data
Course information is sourced in part from third-party providers and may contain inaccuracies. FlagStick doesn't guarantee the accuracy of course data, ratings, or any other user-generated content.
Disclaimers
FlagStick is provided "as is" without warranties of any kind, express or implied. We don't guarantee the app will be uninterrupted, error-free, or that any ranking or rating reflects an objective truth about a course.
Limitation of liability
To the maximum extent permitted by law, FlagStick and its officers, employees, and partners aren't liable for indirect, incidental, or consequential damages arising from your use of the app. Total liability for any claim is capped at the greater of $100 or what you paid FlagStick in the past 12 months.
Indemnification
You agree to indemnify and hold FlagStick, Inc., its officers, employees, and partners harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the app, your User Content, or your violation of these Terms or applicable law.
Termination
You can delete your account at any time from Settings, or by emailing support@flagsstickgolf.com. We can suspend or terminate accounts that violate these Terms or the Community Guidelines, with or without notice, particularly for fraud, abuse, or harm to other users.
Governing Law
These Terms, and any Dispute arising out of or relating to these Terms, your use of the FlagStick app, or the relationship between you and FlagStick, shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict-of-law provisions. Notwithstanding the foregoing, the enforceability and interpretation of the arbitration agreement set forth below shall be governed by the Federal Arbitration Act, 9 U.S.C. §§ 1–16.
Exclusive Jurisdiction and Venue
For any Dispute not subject to arbitration (including claims within the small claims court exception and applications for injunctive relief as set forth below), or in the event the arbitration agreement is found to be unenforceable, you and FlagStick irrevocably consent to the exclusive jurisdiction and venue of the state courts of the State of New York sitting in New York County and the United States District Court for the Southern District of New York. Each party irrevocably waives any objection it may have to the laying of venue in such courts and any claim that any such action or proceeding has been brought in an inconvenient forum.
Consent to Personal Jurisdiction. By creating a FlagStick account and agreeing to these Terms, you irrevocably consent to the personal jurisdiction of the state and federal courts located in New York County, New York, for any proceeding arising out of or relating to these Terms or your use of the FlagStick app.
Dispute Resolution and Binding Arbitration
Agreement to Arbitrate. You and FlagStick, Inc. (“FlagStick”) agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the FlagStick app, or the relationship between you and FlagStick (collectively, “Disputes”) will be resolved exclusively through final and binding individual arbitration, rather than in court, except as expressly provided below. This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1–16, and shall survive termination of these Terms or your FlagStick account.
Informal Resolution First. Before initiating arbitration, you and FlagStick each agree to attempt to resolve any Dispute informally for at least sixty (60) days. To begin the informal process, a party must send the other a written notice (“Dispute Notice”) describing the nature of the claim, the specific relief sought, and the relevant facts. You must send your Dispute Notice by email to support@flagsstickgolf.com with the subject line “Dispute Notice.” FlagStick will send its Dispute Notice to the email address associated with your account. If the Dispute is not resolved within sixty (60) days after the Dispute Notice is received, either party may commence arbitration.
Arbitration Administration. Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, which are available at www.adr.org. If the AAA is unable or unwilling to administer the arbitration, the parties shall agree on an alternative arbitral forum; if they cannot agree within fourteen (14) days, either party may petition a court of competent jurisdiction in New York County, New York, to appoint an arbitrator. A single arbitrator will conduct the proceeding.
Hearing Location. Unless you and FlagStick agree otherwise, any in-person arbitration hearing will take place in New York County, New York. At your request, hearings may be conducted by telephone or videoconference.
Arbitration Fees and Costs. FlagStick will pay all AAA filing, administration, and arbitrator fees and costs for any arbitration it initiates. For any arbitration you initiate, you will pay only the consumer filing fee required under the AAA Consumer Arbitration Rules (currently $200 for claims of $75,000 or less), and FlagStick will pay the remainder. If the arbitrator finds that the filing fee constitutes a barrier to your ability to pursue the claim, FlagStick will pay the filing fee on your behalf upon written request. Each party bears its own attorneys’ fees, unless the arbitrator awards fees to the prevailing party as permitted by applicable law.
Small Claims Court. Notwithstanding the foregoing, either party may bring an individual action in a small claims court of competent jurisdiction for any Dispute within that court’s jurisdictional limits.
Injunctive Relief. Either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction to the extent necessary to protect its intellectual property rights or to prevent imminent, irreparable harm pending arbitration, provided that the merits of the underlying Dispute are resolved in arbitration.
Opt-Out. You may opt out of this arbitration agreement by sending written notice to support@flagsstickgolf.com within thirty (30) days of first creating your FlagStick account. The notice must include the subject line “Arbitration Opt-Out” and state your name and the phone number or email address associated with your account. If you timely opt out, you will not be bound by this arbitration agreement, but all other provisions of these Terms will remain in full force and effect.
Severability. If any portion of this arbitration agreement is found to be unenforceable, the remaining portions will continue in full force and effect, except that if the Class Action and Jury Trial Waiver (below) is found to be unenforceable as to a particular claim or request for relief, then that claim or request for relief shall be severed and proceed in court, while all other claims remain in arbitration.
CLASS ACTION AND JURY TRIAL WAIVER
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
Class Action Waiver. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND FLAGSTICK EACH WAIVE THE RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION, PROCEEDING, OR ARBITRATION. All Disputes between you and FlagStick must be resolved on an individual basis only. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class, collective, or representative proceeding. If a court or arbitrator determines that this class action waiver is unenforceable as to a particular claim or request for relief (such as a request for public injunctive relief), then that claim or request for relief — and only that claim or request for relief — shall be severed from any remaining claims and may proceed in a court of competent jurisdiction, while the remaining claims continue in individual arbitration.
Jury Trial Waiver. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND FLAGSTICK EACH WAIVE THE RIGHT TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE FLAGSTICK APP. If the arbitration agreement is found not to apply to you or to a particular Dispute, you and FlagStick each agree to waive the right to a jury trial in any court proceeding between us.
Changes to these Terms
We may update these Terms; material changes will be communicated in-app or by the contact info on file before they take effect.

Community Guidelines & Content Moderation
FlagStick works because ratings and comparisons are honest. These guidelines cover what's expected of you here, and what happens when they're not followed.
The basics
FlagStick has zero tolerance for objectionable content and abusive users. Content that breaks these guidelines is removed, and accounts that post it can be suspended or banned.
- Rate and review courses based on your real, honest experience
- No fake rounds, fake accounts, or coordinated rating manipulation
- Be respectful in reviews and comments — critique the course, not other people
- No harassment, hate speech, threats, sexual content, or spam
- No impersonating another golfer, a course, or FlagStick staff
Reporting and blocking
- Any user can report a round, review, comment, or profile directly from the app
- Reports go to FlagStick's team and are reviewed within 24 hours
- Any user can block another user. Blocking removes any follow between you, stops either of you from following the other, stops them from tagging you, and hides their rounds, reviews, comments, and profile from you
Enforcement
FlagStick uses a graduated response based on severity and history:
- Warning — first-time, low-severity violations (e.g., an overly harsh but not abusive review)
- Content removal — the specific round, review, or comment is taken down
- Temporary suspension — repeated violations or a single more serious one
- Permanent ban — severe violations (harassment, threats, fake-account networks, doxxing) or repeat offenses after suspension
FlagStick reserves the right to remove content or act on an account without prior notice when there's a safety concern.
Appeals
If you believe a moderation decision was made in error, you can appeal by contacting support@flagsstickgolf.com. We aim to review appeals within 48 hours.
Age requirement
FlagStick is intended for users 13+. Do not create an account if you don't meet this requirement.
